New York State Senator Introduces Unconstitutional, Anti-Free Speech Legislation

Perhaps the greatest irony of this past year has been the mind numbing and irrational anti-free speech wave that swept across facets of so-called “liberal” America.

This regressive movement was most readily apparent on college campuses, where hordes of sheltered and emotionally stunted students demanded restrictions on free speech in order to prevent themselves from being offended by an ever expanding list of unhappy thoughts and words. However, what is far more troubling, albeit much less public, are attempts by two fascist academic authoritarians, to convince the American citizenry to relinquish their First Amendment rights in the name of fighting ISIS. One of these men is a close advisor to President Obama.

It seems everywhere you turn, U.S. politicians at all levels of government are incessantly scheming to figure out ways to further erode the civil liberties of the American public. It relates to an anti-First Amendment executive order issued by Governor Andrew Cuomo, followed one day later by similar legislation introduced by a state Senator. Journalistic Malpractice – How Hillary Clinton “Clinched” the Nomination on a Day Nobody Voted

Last night, Associated Press – on a day when nobody voted – surprised everyone by abruptly declaring the Democratic Party primary over and Hillary Clinton the victor. The decree, issued the night before the California primary in which polls show Clinton and Bernie Sanders in a very close race, was based on the media organization’s survey of “superdelegates”: the Democratic Party’s 720 insiders, corporate donors and officials whose votes for the presidential nominee count the same as the actually elected delegates. AP claims that superdelegates who had not previously announced their intentions privately told AP reporters that they intend to vote for Clinton, bringing her over the threshold. AP is concealing the identity of the decisive superdelegates who said this.

This is the perfect symbolic ending to the Democratic Party primary: The nomination is consecrated by a media organization, on a day when nobody voted, based on secret discussions with anonymous establishment insiders and donors whose identities the media organization – incredibly – conceals. The decisive edifice of superdelegates is itself anti-democratic and inherently corrupt: designed to prevent actual voters from making choices that the party establishment dislikes. But for a party run by insiders and funded by corporate interests, it’s only fitting that their nomination process ends with such an ignominious, awkward and undemocratic sputter.

That the Democratic Party nominating process is declared to be over in such an uninspiring, secretive, and elite-driven manner is perfectly symbolic of what the party, and its likely nominee, actually is. The one positive aspect, though significant, is symbolic, while the actual substance – rallying behind a Wall-Street-funded, status-quo-perpetuating, multi-millionaire militarist – is grim in the extreme. The Democratic Party got exactly the ending it deserved.

Last night, the American public witnessed the most egregious example of mainstream media malpractice of my lifetime. By declaring Hillary Clinton the Democratic nominee based on the pledges of superdelegates who have not voted, and will not vote until the convention on July 25th, the Associated Press performed a huge disservice to American democracy on the eve of a major primary day, in which voters from the most populous state in the union (amongst others) head to the polls. If you are a U.S. citizen and you aren’t outraged by this, there’s something seriously wrong with you.

In this post, I have three objectives. First, I will set the stage by explaining how incredibly sleazy the move by the AP was. Second, I will outline the preposterous and unjustifiable nature of having superdelegates in the first place. Third, I will attempt to convince all true Bernie Sanders supporters to commit themselves to never supporting Hillary Clinton. Let’s get started.

I’m sure that by now most of you are intimately aware of the scathing report issued by the State Department inspector general regarding Hillary Clinton’s unconscionable use of a private server for all her official government emails. It’s now clear that this was no honest mistake, but rather a deliberate attempt to shield her correspondence from the American people.

Hundreds of Turkish academics are waiting to find out whether they will be prosecuted or sacked for spreading “terrorist propaganda”, after they signed a petition calling for violence to end in Turkey’s southeast, where government forces have been fighting Kurdish separatists.

After the petition provoked a furious response from Turkey’s president Recep Tayyip Erdoğan, several universities in the country have begun investigations into signatories among their faculty — which could lead to their dismissal if accusations of unlawful political agitation hold up. On 15 January, police arrested and later released 27 academics, according to local media reports, including economists, physicians and scientists.

Section 213 was included in the Patriot Act over the protests of privacy advocates and granted law enforcement the power to conduct a search while delaying notice to the suspect of the search. Known as a “sneak and peek” warrant, law enforcement was adamant Section 213 was needed to protect against terrorism. But the latest government report detailing the numbers of “sneak and peek” warrants reveals that out of a total of over 11,000 sneak and peek requests, only 51 were used for terrorism. Yet again, terrorism concerns appear to be trampling our civil liberties.

Here, a Clinton match-up is highly likely to be an unmitigated electoral disaster, whereas a Sanders candidacy stands a far better chance. If the Trump/Sanders debate proceeds as planned in California, you’re about to witness one of the most important moments of a 2016 general election that hasn’t even begun yet. To say such a debate would be an unmitigated disaster for Hillary Clinton would be the understatement of the century. Let’s explore why.

First of all, Hillary Clinton outright rejected a debate request from Bernie Sanders ahead of the June 7th California primary. In the first full year after President Barack Obama’s election, that figure was only 65 percent of cases.

When a reporter for the United States Army Training and Doctrine Command interviewed Frank Zappa for the commands news syndicate, the story was held by a superior who demanded that Zappa – who had been rather hard on the army – answer one more question: just who does he think will defend the country without the army? 

Zappa’s reply: “From what? The biggest threat to America today is it’s own federal government…. Will the Army protect anybody from the FBI? The IRS? The CIA? The Republican Party? The Democratic Party?….The biggest dangers we face today don’t even need to sneak past our billion dollar defense system….they issue the contracts for them.” The interview was not run. 

*Note: It’s uncertain whether the above exchange ever took place, since the interview was never run. Nevertheless, the point is clear, instructive and serves as the perfect introduction for this post, whether the words were actually said or not.

One of the greatest afflictions affecting these United States at the moment is the general public’s overwhelming gullibility when it comes to government. You may think this sounds insane given surveys that consistently show Congress with a less than 10% approval rating, but I think this clouds the fact that most people have yet to accept just how completely corrupt and authoritarian government has actually become.

Why Trump Winning the Republican Nomination is Good for American Democracy

While it might sound strange, a coronation of Hillary Clinton in the Democratic primary will mark the end of the party as we know it. There’s been a lot written about the “Sanders surge,” with much of it revolving around Hillary Clinton’s extreme personal weakness as a candidate. While this is indisputable, it’s also a convenient way for the status quo to exempt itself from fault and discount genuine grassroots anger. I’m of the view that Sanders’ support is more about people liking him than them disliking Hillary, particularly when it comes to registered Democrats. He’s not merely seen as the “least bad choice.” People really do like him.

The Sanders appeal is twofold. He is seen as unusually honest and consistent for someone who’s held elected office for much of his life, plus he advocates a refreshingly anti-establishment view on core issues that matter to an increasing number of Americans. These include militarism, Wall Street bailouts, a two-tiered justice system, the prohibitive cost of college education, healthcare insecurity and a “rigged economy.” While Hillary is being forced to pay lip service to these issues, everybody knows she doesn’t mean a word of it. She means it less than Obama meant it in 2008, and Obama really didn’t mean it.

As I wrote on Monday, ever since I started reading about the Panama Papers “leak” something kept rubbing me the wrong way. From the absence of any well known, politically powerful Americans on the list, to the anonymous nature of “John Doe” as whistleblower and the clownish reporting from Soros and USAID affiliated organizations, the whole thing stunk from the start.

The first plausible theory I came across attempting to explain the strangeness of it all was proposed by Craig Murray, and it basically went something like this. The leaker is a real whistleblower, but he placed the information in the wrong hands, therefore the organizations and journalists reporting on the story were not giving us the whole truth. Allen Dulles, the CIA director under presidents Eisenhower and Kennedy, the younger brother of Secretary of State John Foster Dulles, and the architect of a secretive national security apparatus that functioned as essentially an autonomous branch of government. Talbot offers a portrait of a black-and-white Cold War-era world full of spy games and nuclear brinkmanship, in which everyone is either a good guy or a bad guy. Dulles—who deceived American elected leaders and overthrew foreign ones, who backed ex-Nazis and thwarted left-leaning democrats—falls firmly in the latter camp.

Absolutely. The surveillance state that Snowden and others have exposed is very much a legacy of the Dulles past. I think Dulles would have been delighted by how technology and other developments have allowed the American security state to go much further than he went. He had to build a team of cutthroats and assassins on the ground to go around eliminating the people he wanted to eliminate, who he felt were in the way of American interests. He called them communists. We call them terrorists today. And of course the most controversial part of my book, I’m sure, will be the end, where I say there was blowback from that. Because that killing machine in some way was brought back home.

Like so many other cases of egregious financial fraud over the past several years, regulators used softball tactics to go easy on the banks. No bank was even forced to admit wrongdoing in the orders by the US Commodity Futures Trading Commission and the Office of the Comptroller of the Currency. Regulators avoided court and settled for cash, which the traders won’t pay – the bank’s shareholders will. Officials presented a minimal amount of evidence, lacking the full details of the traders’ misconduct. They sought no judicial review.

In short, banks got away with their crimes for a pittance; their stocks even rose on the news of the settlements because the market believes the trouble is over. 

The DoJ has increasingly used a relatively new and declawed method to deal with the aftermath of the financial crisis: the deferred prosecution agreement (DPA). 

No one goes to jail and no one ever gets prosecuted. Under a deferred prosecution agreement, the Justice Department allows corporations to pay a fine, then agree to some enhanced supervision and monitoring. The Justice Department appears to admit this in the US Attorney’s manual, when they describe these deals as “agreements not to enforce the law under particular conditions”.

Each deferred prosecution agreement is negotiated individually. There is no thought to creating a future record: no trials, no jury verdicts, no appellate court decisions, no case law and no binding precedent. This makes it impossible to determine the boundaries of the law. The same conduct can be treated differently, depending on the prosecutor.

Smaller percentages (shown at the end of this article) associate her with Bill Clinton, with the controversy surrounding her use of a private email server while secretary of state and with the Benghazi terrorist attack.

The perceptions of Hillary Clinton as dishonest are not new. When Gallup asked the same question in 2008, “dishonest” was Americans’ most frequent response.

Our founding fathers studied power structures over the millennia and knew exactly what they were doing when solidifying the Bill of Rights into the U.S. Constitution. All it took was a couple hundred years, an extraordinarily ignorant and apathetic American public, and a major terror attack to roll back this multi-generational gift.

For many years, I and countless others have been screaming from the rooftops that a society should never trade civil liberties for security. Life on earth has always been dangerous for us humans, and what has historically separated free and noble civilizations from stunted tyrannies is a willingness to acknowledge such a precarious existence while at the same time demanding and defending one’s dignity and liberty. In the aftermath of the attacks of 9/11, the American public has demonstrated no such strength of character or historical maturity, thus allowing a corrupt, deceptive and lawless government to run roughshod over freedom with very little resistance.

Freedom? Liberty? Don’t be ridiculous.

It’s been a little while since I’ve updated readers on the shady, shameless surveillance practices of the U.S. government. As usual, it’s worse than we thought.
